Proposed Closure of Pinwherry Primary School, Pinwherry and transfer of pupils to
Colmonell Primary School, Colmonell
The public consultation on the proposed closure of Pinwherry Primary School closed
on Friday, 28th January 2011. In accordance with the above Act, all responses received
were passed to Her Majesty’s Inspectorate for Education (HMIe) who considered the
educational impact of the proposal and submitted a report to the Council. Following
receipt of this report, the Council has prepared a Consultation Report which summarised
the outcome of the consultation process. This report has been made available to
all consultees for further consideration for a period of 3 weeks after which the
report will be submitted to the Council’s Leadership Panel on Tuesday, 19th April
2011 for consideration and a decision.
If a decision is taken to close Pinwherry Primary School, the Council must notify
Scottish Ministers of this decision who have the power to issue a call-in notice
regarding a closure decision, but only where it appears to the Scottish Ministers
that the Council has failed in a significant regard to comply with the requirements
of the Act, or to take proper account of a material consideration relevant to its
decision to implement the proposal. Ministers have six weeks to decide whether or
not to issue a call-in notice.
During the first three weeks of the six week period, any person or group will be
able to make representation to the Scottish Ministers on whether a decision should
be called-in. Any relevant representations must be taken into account by the Scottish
Ministers when deciding whether or not to issue a call-in notice.
During this period the Council may not proceed further with the proposed closure.
Ministers may come to a decision sooner than six weeks (but not before the three
weeks for representation to be made to them has elapsed).
