Road Bonds

In terms of Section 17 of The Roads (Scotland) Act 1984 and the Security for Private Roadworks (Scotland) Regulations 1985 developers are required to make financial provision with the local Roads Authority in order to safeguard the completion of housing development roads which are the subject of a Construction Consent.

The 1985 regulations were established, under the powers in the Roads (Scotland) Act 1984, to protect the purchaser of a new house if a developer defaults by failing to complete the road serving the property. The regulations require that developers should lodge security in the form of a road bond with the local roads authority; this is to ensure that funds

It should be noted that no building work can commence until such securities have been lodged.
