Permission to Use a Raised Structure
Any person who uses or permits the use of a raised structure or structures for the
purpose of providing for themselves or others raised accommodation requires the
approval of South Ayrshire Council under Section 89 of the Civic Government (Scotland) Act 1982.
A “Raised Structure” means a platform, stand, staging or any similar structure which
provides seating or standing accommodation. South Ayrshire Council, Building Standards
Service consider a “Raised Structure” to be a structure which is 600mm or more above
surrounding ground/floor level. Examples include a temporary grandstand, temporary
seating at golf, bowling, circus, pop concerts, hall staging, boxing etc.

What happens next?
Applicants must provide an Application Form (Form 89-1), information and plans to
South Ayrshire Council within the time specified. A “Design Certificate for the
Erection of a Raised Structure” (Form 89-2), signed by a Full Member of the Institution
of Civil Engineers or the Institution of Structural Engineers will also normally
be required.
South Ayrshire Council will then consider the application, and request any further
information and drawings from the applicant thought necessary.
As part of the statutory application process, a copy of the application form, and
all drawings, certification and information will be sent to Strathclyde Fire &
Rescue.
Following construction of the raised structure, a “Certificate of Completion of
Erection and Inspection of a Raised Structure (Form 89-3), signed by a Full Member
of the Institution of Civil Engineers or the Institution of Structural Engineers
must be submitted.
Normally 24 hours notice will be given to South Ayrshire Council Building Standards
Service that a raised structure has been constructed and is ready for inspection.
Following a successful inspection, a “Consent to Use a Raised Structure” (Form 89-4)
will be issued to the applicant. It should be noted that this permission is not
valid until all the conditions contained in the Schedule are complied with.
It is in the public interest that the South Ayrshire Council must process your application
before it can be granted. We would expect to process your application within 14
calendar days or 10 working days. If you have not heard from us within a reasonable
period, please contact us.
Will Tacit Consent Apply?
Tacit Consent does apply. If you have not received a response within six months you may act as if a licence has been granted.
